1. Agreement
These Terms govern your access to and use of the Neouptime uptime-monitoring service ("Service"). By creating an account or using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.
2. The Service
Neouptime monitors endpoints you configure and notifies you of availability changes. We aim for high availability but the Service is provided on an "as is" and "as available" basis. Monitoring intervals, check types, and feature limits depend on your plan.
3. Accounts & security
You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly of any unauthorized use. You must provide accurate account information and only monitor endpoints you are authorized to monitor.
4. Acceptable use
You may not use the Service to monitor targets without authorization, to launch or facilitate attacks, to send unlawful content, or to attempt to disrupt or reverse-engineer the Service. We may suspend accounts that violate these Terms.
5. Plans, billing & cancellation
Paid plans are billed in advance on a monthly or annual cadence through our payment processor, Stripe. Fees are non-refundable except where required by law. You may cancel at any time through the billing portal; cancellation takes effect at the end of the current billing period, and downgrades may reduce the features and limits available to you.
6. No guarantee of detection
The Service is a monitoring aid, not a guarantee. We are not liable for outages, missed alerts, or losses arising from undetected or unreported incidents. You remain responsible for the systems you monitor.
7. Intellectual property
The Service, including its software and branding, is owned by Neouptime and its licensors. You retain ownership of the data you submit; you grant us the rights needed to operate the Service on your behalf.
8. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or to comply with law. On termination, your right to use the Service ends.
9. Limitation of liability
To the maximum extent permitted by law, Neouptime is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid for the Service in the twelve months before the claim.
10. Changes & contact
We may update these Terms; material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance. Questions: legal@neouptime.com.
